The Verkhovna Rada passed in the second reading the Law "On Amendments to Some Laws of Ukraine regarding the settlement of certain issues in the provision of housing and communal services.
This document was developed to improve the norms and provisions of the current legislation of Ukraine governing the provision and consumption of housing and communal services, their payment, formation, and establishment of prices/tariffs for public services.
The law allows streamlining the process of concluding contracts for the provision of public services and the process of transition to new relations in the sphere of public services in accordance with the requirements of the Law of Ukraine of 09.11.2017 № 2189-VIII "On housing and communal services", leaving the co-owners of the apartment building to choose models of contractual relations.
The adopted Law allows co-owners of an apartment building to enter into a contract for the provision of public services with the provider of the corresponding public utility service (except for the natural gas supply and distribution services and electricity supply and distribution services), in particular:
- an individual contract with the maintenance of in-house systems concluded by each co-owner of the apartment building independently provided that the co-owners have decided on a suitable model of the organization of contractual relations and have agreed with the utility service provider on the amount of payment for maintenance of in-house systems of the apartment building;
- a collective bargaining agreement concluded on behalf and at the expense of all co-owners of the apartment building by the building manager or another person authorized by the co-owners;
- a contract for the provision of public utilities with a collective consumer concluded with the association of co-owners of an apartment building or other legal entity that unites all co-owners of such building and concludes the relevant contract in their interests.
At the same time, the above-mentioned co-owners are given the opportunity to independently choose one of the models of contractual relations for each type of utility services separately (except for the natural gas supply and distribution services and electric power supply and distribution services).
