With the beginning of 2019 the ongoing restriction on business inspections by regulatory authorities were lifted. Thus, the State Regulatory Service of Ukraine has published The Plan of implementation of comprehensive measures of state supervision (control) in 2019, which provides for 110,497 scheduled inspections, 3,233 unscheduled inspections and 30,227 comprehensive inspections.
The set of measures planned for implementation by the supervisory authorities is extensive, but it allows, using the provided tools, successfully prepare for the upcoming visits. Using a convenient search format, you can check your company`s entry in the lists of companies that is going to be checked. In case the company was included in the list of the portal, it`s instrument allows to receive information about specific visitors from the controlling authorities and the date of their arrival.
The main legislative act regulating inspection procedures is the Act of Ukraine "The Basic Principles of State Supervision (Control) in the Sphere of Economic Activity". However, it is also worth noting that the Decree of the Cabinet of Ministers of Ukraine № 295 of 26.04.2017 "About some issues of implementation of Article 259 of the Labor Code of Ukraine and Article 34 of the Act of Ukraine "About Local Self-Government in Ukraine" were removed State Labour Inspection Service from the control measures of the scope of the said Act.
In accordance with the provisions of the said Decree, the State Labour Inspection Service does not develop plans for its inspection visits and is not obliged to warn economic entities about their carrying out. Therefore, the State Labour Inspectorate does not organize scheduled or unscheduled inspections, which provided for by the regulatory law, but carries out inspection visits and non-visit inspections according to the Decree of the Cabinet of Ministers of Ukraine № 295 dated April 26, 2017.
